refers to the AI-powered model evaluation and grading tools provided by PromptKey AI, including comparison services, SME grading, jury LLM evaluation, analytics dashboards, and related features.

refers to anyone accessing our website or platform, including individuals and organizations with registered accounts.
- Content
includes text, prompts, responses, evaluations, metrics, graphics, software, and data available on or processed through our platform.
- API Keys
refers to authentication credentials provided by users to access third-party LLM services.
Account Registration and Security
- You must register for an account to use our full services.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information when registering.
- You are solely responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
User Responsibilities
By using our service, you agree to:
- Provide accurate and complete information when registering an account.
- Use the platform only for lawful purposes and in accordance with these Terms.
- Not engage in harmful or fraudulent activities, including unauthorized access to data.
- Not attempt to probe, scan, or test the vulnerability of our system or network.
- Not use our services to evaluate or generate illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content.
- Not upload or transmit viruses, malware, or other malicious code.
- Not interfere with or disrupt the integrity or performance of the service.
API Keys and Third-Party Services
- You are responsible for obtaining and maintaining valid API keys for any third-party LLM services you wish to evaluate.
- You grant us permission to use your provided API keys solely to perform the specific evaluation services you request.
- You acknowledge that charges may be incurred on your third-party LLM service accounts based on usage through our platform.
- You are responsible for all costs associated with your use of third-party services.
- We recommend using API keys with appropriate usage limits.
- We are not responsible for any issues, outages, or changes in third-party services.
Data Usage and Privacy
- You retain ownership of your content and data submitted to our platform.
- You grant us a license to use your content solely for providing and improving our services.
- We will handle your data in accordance with our Privacy Policy.
- You represent that you have all necessary rights to submit content to our platform and that doing so does not violate any third-party rights.
- You acknowledge that model evaluations may involve processing your content through multiple LLM services.
Intellectual Property Rights
- PromptKey AI retains all ownership and intellectual property rights to its services, platform, technology, and content.
- Users may not copy, modify, distribute, sell, or lease any part of our service or included software without permission.
- Our name, logo, and other branded elements are our trademarks and may not be used without prior written permission.
- We respect intellectual property rights and expect users to do the same.
Payment and Billing
- Our pricing follows a pay-as-you-go model per evaluation job, with subscription options available.
- Users will receive upfront pricing before being charged.
- Payments are processed securely through third-party providers.
- You agree to pay all fees and charges incurred through your account.
- All fees are exclusive of applicable taxes, which you are responsible for paying.
- We reserve the right to change our pricing with reasonable notice.
- No refunds will be provided for completed evaluation services unless required by law.
Service Limitations and Modifications
- We strive to provide uninterrupted service but do not guarantee that the service will be available at all times.
- We reserve the right to modify, suspend, or discontinue any part of our service at any time.
- We may impose limits on certain features or restrict access to parts of the service without notice or liability.
- We are not responsible for delays or failures in performance beyond our reasonable control.
Termination
- You may terminate your account at any time by following the instructions on our website.
- We reserve the right to suspend or terminate your access to our services if:

- You engage in fraudulent or illegal activities

- You agree to indemnify and hold us harmless from any claims arising from your use of the service or violation of these Terms.
Confidentiality
- We treat your evaluation data and results as confidential information.
- We will not disclose your confidential information except as permitted by our Privacy Policy.
- We implement reasonable safeguards to protect your confidential information.
- You agree to maintain the confidentiality of any non-public information about our service that you may receive.
Feedback and Suggestions
- Any feedback or suggestions you provide regarding our services may be used without any obligation to compensate you.
- We do not waive any rights to similar or related ideas previously known to us, developed by our employees, or obtained from other sources.
Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of DE, without regard to its conflict of law principles.
Dispute Resolution
- Any disputes arising from these Terms shall be resolved through good faith negotiations.
- If negotiations fail, disputes shall be submitted to binding arbitration in DE.
- You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
